{"id":499,"date":"2019-01-06T17:26:34","date_gmt":"2019-01-06T17:26:34","guid":{"rendered":"http:\/\/corporatecenter.com.br\/home\/?p=499"},"modified":"2019-01-06T17:26:34","modified_gmt":"2019-01-06T17:26:34","slug":"parecer-do-stj","status":"publish","type":"post","link":"https:\/\/corporatecenter.com.br\/home\/?p=499","title":{"rendered":"Parecer do STJ"},"content":{"rendered":"<h3>Propriet\u00e1rio atual s\u00f3 responde por d\u00edvida condominial antiga se posterior ao registro do condom\u00ednio<\/h3>\n<hr \/>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-502 size-full\" src=\"http:\/\/corporatecenter.com.br\/site\/wp-content\/uploads\/2019\/01\/stj.jpg\" alt=\"\" width=\"640\" height=\"310\" srcset=\"https:\/\/corporatecenter.com.br\/home\/wp-content\/uploads\/2019\/01\/stj.jpg 640w, https:\/\/corporatecenter.com.br\/home\/wp-content\/uploads\/2019\/01\/stj-300x145.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/p>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">O registro da conven\u00e7\u00e3o de condom\u00ednio \u00e9 o momento no qual a obriga\u00e7\u00e3o pelas taxas condominiais passa a ter car\u00e1ter propter rem, por isso as d\u00edvidas anteriores a essa data devem ser cobradas de quem era o propriet\u00e1rio do im\u00f3vel \u00e0 \u00e9poca.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">Com esse entendimento, a Terceira Turma do Superior Tribunal de Justi\u00e7a (STJ) deu parcial provimento ao recurso do atual propriet\u00e1rio, inscrito em cadastro de devedores por d\u00edvidas condominiais da \u00e9poca em que o im\u00f3vel ainda era do antigo dono.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">O recorrente foi inscrito em servi\u00e7o de prote\u00e7\u00e3o ao cr\u00e9dito pelo n\u00e3o pagamento de cotas condominiais no per\u00edodo de outubro de 2008 a mar\u00e7o de 2010. Ele adquiriu o im\u00f3vel em 31 de mar\u00e7o de 2010.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">No recurso, sustentou que, ao tempo da forma\u00e7\u00e3o da alegada d\u00edvida, o edif\u00edcio n\u00e3o preenchia os requisitos legais para ser considerado um condom\u00ednio, e dessa forma o d\u00e9bito teria natureza pessoal, e n\u00e3o propter rem, devendo a cobran\u00e7a ser dirigida ao propriet\u00e1rio anterior.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">A ministra Nancy Andrighi, relatora do recurso, citou o Tema 882 dos recursos repetitivos para afirmar que, na aus\u00eancia de condom\u00ednio formalmente constitu\u00eddo, \u00e9 preciso anu\u00eancia do associado para que este se torne respons\u00e1vel pelas d\u00edvidas relacionadas \u00e0 associa\u00e7\u00e3o de moradores.<\/h4>\n<h4 class=\"m-paragraph\">\u201cPreviamente ao registro da conven\u00e7\u00e3o de condom\u00ednio, as cotas condominiais n\u00e3o podem ser cobradas junto ao recorrente. Por\u00e9m, aquelas d\u00edvidas surgidas posteriormente \u00e0 conven\u00e7\u00e3o devem ser consideradas de natureza propter rem\u201d, justificou a relatora.<\/h4>\n<h4 style=\"text-align: justify;\">Marco divisor<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">A relatora destacou que, uma vez constitu\u00eddo o condom\u00ednio, a jurisprud\u00eancia do STJ aponta no sentido de que todas as obriga\u00e7\u00f5es condominiais decorrentes t\u00eam car\u00e1ter propter rem.<\/h4>\n<h4 class=\"m-paragraph\">\u201cDevidamente estabelecido o condom\u00ednio, todas as despesas condominiais s\u00e3o obriga\u00e7\u00f5es propter rem, isto \u00e9, existentes em fun\u00e7\u00e3o do bem e, assim, devidas por quem quer que o possua\u201d, explicou a ministra.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">A conven\u00e7\u00e3o do condom\u00ednio foi registrada em julho de 2009, e \u00e9 preciso, segundo a relatora, estabelecer o correto marco temporal a partir do qual as d\u00edvidas condominiais s\u00e3o devidas pelo recorrente, atual propriet\u00e1rio do im\u00f3vel.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">Segundo ela, previamente ao registro da conven\u00e7\u00e3o de condom\u00ednio, as cotas condominiais n\u00e3o podem ser cobradas do recorrente. \u201cPor\u00e9m, aquelas d\u00edvidas surgidas posteriormente \u00e0 conven\u00e7\u00e3o (09\/07\/2009) devem ser consideradas de natureza propter rem e, portanto, s\u00e3o tamb\u00e9m opon\u00edveis ao recorrente\u201d, resumiu a relatora ao justificar o parcial provimento.<\/h4>\n<h4 style=\"text-align: justify;\"><\/h4>\n<h4 class=\"m-articleA__body__source\" style=\"text-align: justify;\">Fonte:
