O entendimento \u00e9 da 3\u00aa Turma do Superior Tribunal de Justi\u00e7a.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">Segundo a decis\u00e3o, a d\u00edvida de condom\u00ednio \u00e9 obriga\u00e7\u00e3o propter rem, por isso admite-se, inclusive, a sucess\u00e3o processual do antigo executado pelo arrematante.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">Na a\u00e7\u00e3o, o arrematante contestou sua inclus\u00e3o no polo passivo da a\u00e7\u00e3o de cobran\u00e7a de cotas condominiais na fase de cumprimento de senten\u00e7a, j\u00e1 que n\u00e3o participou do processo de conhecimento que constituiu o t\u00edtulo executivo.<\/h4>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">Em seu voto, o ministro relator do processo, Paulo de Tarso Sanseverino, ressaltou que a 2\u00aa Se\u00e7\u00e3o j\u00e1 enfrentou a quest\u00e3o da natureza jur\u00eddica da obriga\u00e7\u00e3o relativa a d\u00e9bitos condominiais, ocasi\u00e3o em que se firmou a tese de que tais despesas s\u00e3o de responsabilidade do propriet\u00e1rio da unidade imobili\u00e1ria, ou de quem tenha posse, gozo ou frui\u00e7\u00e3o do im\u00f3vel, desde estabelecido rela\u00e7\u00e3o jur\u00eddica direta com o condom\u00ednio.<\/h4>\n<p class=\"m-paragraph\">&#8220;A obriga\u00e7\u00e3o de pagar a taxa condominial surge do liame entre uma pessoa e uma coisa \u2014 no caso, o im\u00f3vel arrematado. Logo, se o direito no qual se funda \u00e9 transmitido, a obriga\u00e7\u00e3o o segue, seja qual for a forma de transfer\u00eancia&#8221;, afirmou.<\/p>\n<h4 class=\"m-paragraph\" style=\"text-align: justify;\">Outro ponto destacado pelo relator, que citou julgados anteriores da 3\u00aa e da 4\u00aa turmas, \u00e9 a obrigatoriedade de o edital da hasta p\u00fablica explicitar os d\u00e9bitos do im\u00f3vel como condi\u00e7\u00e3o para que se responsabilize o arrematante por eventuais d\u00edvidas. &#8220;Colhe-se dos autos que o arrematante, ora recorrente, tinha plena ci\u00eancia do d\u00e9bito discutido nos autos&#8221;, concluiu o ministro.
